If the notes were never stolen then why would it be a crime to sell them. If Henley alleges they were stolen then why did he not report to the police or sue the person in possession of the notes for decades?
It appears Henley and his greedy agent suddenly became concerned recently when the person in possession of the notes were going to sell them. They viewed it as someone making money off the Eagles without them making money.
